Terms of service

These terms govern your use of the Fondest website, label designer (“Studio”) and Shopify app, and orders for custom-labelled hot sauce, condiments and drink mixers. They are an agreement between you and Fondest (“we”, “us”). By using the service or placing an order you agree to them.

1. Who does what

Fondest designs and sells custom-label hot sauce, condiments and drink mixers, made in Colorado. We are the seller: we take your order and payment, answer your questions and handle any problem with your order. The products are produced for Fondest by an independent production partner, a licensed commercial food producer in Colorado, which makes and bottles the product and prints and applies your label. Our production partner is not a party to these terms.

2. Your designs and content

• You keep ownership of the text, photos and logos you add. You give us and our production partner a license to store, reproduce and print them as needed to show previews, produce your order and, for brand merchants, create the products you ask for in your store.
• You confirm you have the rights to everything you upload or type — including other people’s names and likenesses, trademarks and artwork — and that your label is not unlawful, defamatory, hateful or misleading.
• We may refuse or cancel an order whose label we reasonably believe infringes someone’s rights or breaks these rules.
• Designs generated with our AI feature are suggestions based on your inputs and our templates. Review them before ordering; you are responsible for the final label.

3. Label content and compliance

Each label includes a panel with the Nutrition Facts, the ingredient statement and the manufacturing and lot details, which our production partner prints at bottling, and the net contents statement on the front. You may not remove or obscure this information. You are responsible for any other claims you add to your label (for example “organic”, health or origin claims); brand merchants are responsible for complying with the laws that apply to how and where they sell.

4. Orders, pricing and payment

• Orders start at 48 bottles and increase in cases of 24, up to 4,800 bottles, one product, one flavor and one label per order. Prices and flat-rate shipping are shown on our pricing page and confirmed at checkout, where sales tax is added where it applies.
• Payments are processed by Stripe. We never receive your full card number. An order is accepted when payment is complete; an order that is not paid before its checkout expires is cancelled automatically.
• Before you order, you check and approve a proof of your label. We print exactly what you approved, so please check spelling, colors and layout carefully; printed colors may shift slightly from your screen. If something needs to change, reply to your order confirmation within 24 hours of payment; after that your labels go to print.
• Once your payment goes through, your design is locked for production; later edits are saved as a new design.
• We may correct obvious pricing errors. If we cannot fulfil an order, we will cancel it and refund what you paid to your original payment method.

5. Production, shipping and returns

• We ship to one address in the United States per order. We do not ship internationally. Production times depend on our production schedule; any dates we give are estimates. Risk of loss passes to you when the carrier delivers your order.
• Custom-labelled products are made to order and can’t be returned for a change of mind. If bottles arrive damaged, leaking or misprinted compared with your approved design, contact us within 14 days of delivery with photos and we will replace them or refund you.
• Screen colors vary; small differences between on-screen previews and printed labels are not defects.

6. Brand merchants (Shopify app)

• The Fondest app is free. You pay only for stock orders — wholesale bottles at our published wholesale tiers plus flat-rate shipping — by card through Stripe when you place each order.
• Stock is shipped to the address you give at checkout. We do not ship to your customers for you. You are the seller of record for anything you resell: you set your prices and are responsible for your store, customer service, the taxes you collect and the refunds you grant.
• If you ask us to, the app creates a draft product in your Shopify store after payment and adds the ordered bottles to its inventory when the stock ships. Review every product before you publish it.
• If you uninstall the app we stop accessing your store; orders already paid are still produced and shipped.

7. Acceptable use

Don’t misuse the service: no attempts to break security, overload our systems, scrape at scale, or use the AI feature to produce unlawful content. We may limit or suspend access to protect the service.

8. Disclaimers and liability

Hot sauce is hot. Heat levels are our own 1–5 guide to how hot a flavor tastes, not a measurement, and people feel heat differently. Check ingredients for allergens before serving. Except where the law does not allow it, the service is provided “as is”, and our total liability for any claim is limited to the amount you paid for the order concerned. We are not liable for indirect or consequential losses.

9. General

These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws rules, subject to any consumer protections that apply where you live. We may update these terms by posting a new version on this page. Questions: hello@getfondest.com.
